Legal Regulation of Machine Safety
The essential safety requirements for manufacturers of machinery are set forth in the Technical Regulation “Machinery Safety”, which transposes the requirements of EU Directive 2006/42/EC into Lithuanian law, as well as in other national legislation, machine safety standards, and technical regulations.
This regulation applies to manufacturers of equipment and their authorized representatives and stipulates that new work equipment placed on the European Union market or put into service for the first time must:
- comply with the established safety requirements;
- not to pose a risk to human health and safety;
- be marked with the CE mark.
Use of Work Equipment in Lithuania
In Lithuania, the minimum occupational safety and health requirements applicable to work equipment and its use in the workplace are established by the General Provisions on the Use of Work Equipment.
It is important to note that:
- All work equipment put into service after these provisions take effect must comply with the requirements of the directives and regulations in force at that time;
- Such equipment must be accompanied by documentation certifying its compliance.
It is also important to note that work equipment manufactured for personal use (homemade) must also comply with the safety requirements applicable to it at the time of manufacture.
CE Marking and Manufacturer Liability
When placing equipment (machinery) on the market, manufacturers must ensure that all applicable requirements are identified and met. The CE marking confirms that the manufacturer has assessed and met the essential health and safety requirements during the design and manufacturing processes.
The manufacturer or its authorized representative is responsible for:
- the performance of the conformity assessment procedure for the device;
- preparation of technical documentation (technical files);
- the preparation of a conformity document (e.g., an EC/EU Declaration of Conformity);
- CE marking of the product.
